Terms of Service

These terms form the agreement between you and Drishya Cloud Pvt. Ltd. for the hosting, domain, email, and cloud services ordered through drishyacloud.com. By placing an order you accept these terms.
1. Accounts and accuracy
You must provide accurate contact and billing information when ordering. Domain registrations in particular depend on correct registrant details.
You are responsible for keeping your account credentials secure. Actions taken through your account are treated as yours.
2. Orders, billing, and renewals
Services are billed in advance on the term you select (monthly, annually, or multi-year). Invoices are issued through our billing system and payable by the listed methods, including bank transfer, eSewa, Khalti, Fonepay, and PayPal.
Bank-transfer and QR orders are provisioned after the payment is reviewed and confirmed.
Renewal invoices are generated before the due date. Services unpaid after the due date may be suspended, and later terminated, after notice.
Domain registrations, transfers, and renewals are final once submitted to the registry and are non-refundable.
3. Acceptable use
You may not use the services for anything unlawful, including phishing, malware distribution, spam, copyright infringement, or attacks on other systems.
Shared hosting resources must be used fairly. Accounts that persistently degrade the platform for other customers may be asked to upgrade to a VPS or dedicated resources.
We may suspend a service immediately where it poses a security or legal risk to the platform or other customers. We will notify you and work with you to restore service where possible.
4. Service level agreement (SLA)
We target 99.99% network uptime for hosting services, measured monthly and excluding scheduled maintenance announced in advance.
If uptime in a calendar month falls below the target because of a failure within our control, you may request service credit against a future invoice. Credits are the sole remedy for downtime.
The SLA does not cover outages caused by factors outside our control — including upstream connectivity failures, DNS misconfiguration on your side, attacks targeting your site, or suspensions for non-payment or abuse.
5. Backups and data
Backup options are provided as a convenience. You remain responsible for keeping your own copies of critical data.
When a service is terminated, associated data is deleted after a short grace period and cannot be recovered afterwards.
6. Liability
Services are provided “as is”. To the maximum extent permitted by law, our total liability for any claim related to a service is limited to the fees you paid for that service in the three months before the claim arose.
We are not liable for indirect losses such as lost profits, lost data (see backups above), or reputational damage.
7. Cancellation and termination
You can cancel a service from the client area at any time; cancellation takes effect at the end of the paid term unless you request immediate termination.
We may terminate the agreement for material breach of these terms, with notice where practical.
8. Changes and governing law
We may update these terms from time to time; the current version is always published on this page. Continued use of the services after a change constitutes acceptance.
These terms are governed by the laws of Nepal, and disputes fall under the jurisdiction of the courts of Kathmandu.
